Restoring Public Confidence in Elected Officials
As Chairman of the Senate Rules and Administration Committee, I had the privilege of managing debate on the first bill brought to the Senate floor in the 110th Congress – S.1, the Legislative Transparency and Accountability Act.
This landmark ethics, lobbying, and earmark reform package was approved by the Senate on January 18, 2007. Final passage of this legislation will be the most direct action that Congress can take to show the American people that tighter rules and procedures are in place and that the corrupt practices of the few will not be permitted.
One message that was very clear in the 2006 mid-term election was the need for Congress to immediately take steps to restore the public’s trust. When one reviews the scandals that were exposed last year, this is not surprising. The ties between lobbyists and lawmakers must be broken.
This legislation seeks to restore public trust in its elected officials. S. 1 broadens lobbying disclosure requirements, imposes a two-year lobbying moratorium on Members of Congress and top executive branch officials after they leave office, and eliminates lobbyist-funded gifts, meals, and travel. It also increases the penalties for violations of lobbying disclosure laws.
S. 1 makes it more difficult to add earmarks into legislation by requiring that all earmarks included in bills, joint resolutions, committee reports and conference reports be disclosed, along with the name of the Member who sponsored them, and that the information be posted publicly on the Internet for at least 48 hours before consideration on the Senate floor.
Final passage of this bill will demonstrate once and for all that we care more about representing the American people than the perks of power.
S.1, the Legislative Transparency and Accountability Act of 2007 was introduced on January 4, 2007 by Senate Majority LeaderHarry Reid. The bill is co-sponsored by 15 Senators, including Minority Leader Mitch McConnell, Chairman of the Senate Rules Committee Diane Feinstein, and Chairman of the Senate Homeland Security and Governmental Affairs Committee Joseph Lieberman. The bill is based on a S.2349, the 527 Reform Act of 2006, which passed the Senate on March 29, 2006, in the 109th Congress, on a 90-8 vote.
On May 23, 2006, the House took up consideration of S.2349 and amended it in the form of a substitute by inserting the provisions of H.R.4975, the 527 Reform Act of 2006. H.R.4975 had originally passed the House by unanimous consent on May 3.
S.2349, as amended,passed the House without objection. On that same day, May 23, the Senate rejected the House amendment, requested a conference, and appointed conferees. No further substantial action was taken until S.1 was introduced as the first bill of the 110th Congress.
The Senate will begin consideration of S.1 on Tuesday, January 9, 2007 at 11:00 am. Senators Feinstein and Lieberman will serve as managers. The legislation is expected to be covered on the floor for two weeks.
The Honest Leadership and Open Government Act of 2007 (Pub.L. 110–81, 121 Stat. 735, enacted September 14, 2007) is a law of the United States federal government that amended parts of the Lobbying Disclosure Act of 1995. It strengthens public disclosure requirements concerning lobbying activity and funding, places more restrictions on gifts for members of Congress and their staff, and provides for mandatory disclosure of earmarks in expenditure bills. The bill was signed into law by President George W. Bush on September 15, 2007.[1]
