Judge Blocks Key Sections of Arizona's Immigration Law
A judge on Thursday blocked the most controversial sections of Arizona's new immigration law from taking effect, handing a major legal victory to opponents of the legislation.
The law will still take effect Thursday, but without many of the provisions that angered opponents -- including sections that required officers to check a person's immigration status while enforcing other laws. The judge also put on hold a part of the law that required immigrants to carry their papers at all times, and made it illegal for undocumented workers to solicit employment in public places.
U.S. District Judge Susan Bolton put those sections on hold until the courts resolve the issues.
Opponents say the law will lead to racial profiling and is trumped by federal immigration law.
Thanks for the responses to this blog, but the biggest question that I have is how are those police officers with limited knowledge about the immigration laws going to enforce bits and pieces of the law. If I were those officers, I'd go into another profession. That's like asking me to be ICE when the undocumented come into the hospital for treatment. I would find another job!

I'm confused. I have no idea how if the sheriffs in Arizona are successful at obtaining "illegals" how and who will foot the bill to detain/house them until they can be handed over to ICE/ Border Control? Is it the federal govt or the state (tax payers) of Arizona. I really think that this is a recipe for chaos and even more confusion. Right now~~~ the law officers can't ask people they stop to produce their papers~~~ that's a darn good injunction and the people who made this law are angry. It's good for them, because without the undocumented workers that state doesn't even stand a chance. If I were the immigrants in that state, I'd move just to prove a point.

@ Sister Irma, [I still don't fully understand if the Judge was using his or any law suits that had challenged this bill1070...does anyone know how this Judge got to be able to challenge this bill or was she doing it for the state as an over all check for the state? (smile) ]

Arizona Judge Draws Line Between State and Federal Authority Focus Must Now Return to Comprehensive Federal Solutions
July 28, 2010
Washington, D.C. - Today, Phoenix district court judge Susan Bolton enjoined key provisions of Arizona's controversial immigration law, SB 1070. The judge recognized that the federal government has primary authority over making and enforcing immigration law, and that while states have limited authority in this arena, they cannot interfere with federal enforcement or undermine federal priorities. The decision acknowledges the complex nature of immigration law and the harmful consequences of local police attempting to make immigration determinations. The judge also recognized the serious strain that the Arizona law would place on federal resources, which would detract from the federal government's ability to enforce immigration laws in other states and target resources toward serious criminals.
The following is a statement from Benjamin E. Johnson, Executive Director of the American Immigration Council.
"It is clear that Judge Bolton has a strong grasp on the complexity of immigration issues and the challenges facing the state. She blocked the most controversial and troubling parts of the law that not only intrude on the Federal government's authority over immigration, but were also likely to violate the civil rights of legal immigrants and U.S. citizens. While it is important to acknowledge that there are serious problems in Arizona, if Arizonans truly want to target human trafficking, human smuggling, and other serious crimes, they must focus their efforts and resources on those criminal networks, and nothing in today's decision prevents them from doing so.
Now the question is whether politicians at the state and federal level will stop playing politics and start solving problems. Arizona must start focusing on serious criminals and the federal government must assume its Constitutional duty of fixing the broken immigration system. America needs real solutions that make our communities safer, our border more secure, and finally fix our broken immigration system."

Jen, when I heard about this ruling, I decided to write a blog on this matter...now i can write it next week as a re: to your blog....
My main problem with this bill is how the public nor our politicans seem to want to discuss how the state of Arizona or any other state with an " illegal immigration problem" about how they can save time, money and a lot of the needs to discriminate by just going to the work places that they already know SPECIALIZE in hiring illegals in the first place...
to me just talking about this would save the needs for countless law suits/returning our country back to the future of what Hitler's administration did to the Jews ?????????!!!!!!!!!!!!!!!!!????...
but "I" guess if America would do something like this it would have an effect, affect on accusing our president by way of those Hitler signs and may be would go against the Skin heads in their praise, uniforms, saluts for Hitler in 2010- 2012 ????????!!!!!!!!!!!!!???????????????!!!!!!!!!!! (NUP)

Jen it is simple if we just come to accept we have a Constitution...we have ammendments to this Constitution. example, ARTICLE 1...SECTION 8...CONGRESS IS TO MAKE LAWS WHICH SHALL BE NECESSARY AND PROPLER FOR CARRYING INTO EXCUTION THE FOREGOING POWERS AND ALL OTHER POWERS VESTED BY THIS CONSTITUTION IN THE GOVERNMENT OF THE USA OF IN ANY DEPARTMENT OF OFFEDER THERE OF... in lay man's terms only Congress can deal with foreign governments...

I can only speak for our local area on illegal immigrents...They usually get caught at work with false papers and all they have to do is pay a fine and keep right on working...just plain old common sense teaches those fruit and nut growers that without these same people's coming to work in their fields they have no business! The majority workers are legal and illegal workers, school teachers and students and the familys who own the orchards.
The only major thing that gets the most attentiion is the living conditions these people have to live in other than that there are few problems. (smile)
NOw the illegals here that cause death and distruction are tose selling drugs when they have drug wars breaking out every now and...One drug lord gets deported and before he/ she can get back here someon has taken over their 'turf' and all hell breaks loose...so far the illegal growning pot in the mountains and our public parks so far they show all of the tons of marjianl and pictures of the size of the crop's which can run for miles, but they never catch anyone that does the tendings of these crops...
a big thing now is to grow pot in these empty houses or buy then knock out the inside of the homes ad start growing and growing and growing pot. lol (NUP)
but as it will soon be able to be taxed in Ca. this will produce yet another crime wave as the prices go down and the state can hire back police special units to handle this...

Jen one of those officers a Officer david Salgedo was being interviewed by Rich on Rich List @CNN today talking about how he had filed a law suit against this law. He said if they did not obey this law in Arizona he would be sued and if he did obey it he would also be sued...and he said that reading a sheet of paper and seeing a 45 minute vedio was not proper training for him to chance getting fireed and he went to his attorney with this threat to hi s 19 years on the police force.
I still don't fully understand if the Judge was using his or any law suits that had challenged this bill1070...does anyone know how this Judge got to be able to challenge this bill or was she doing it for the state as an over all check for the state? (smile)
