USE MUSKETS TO KEEP PEACE AND ORDER IN PUBLIC NOT TO USE AUTOMATIC RIFLES TO PUT 30 BULLETS IN THE BODY OF A 3 YR. OLD NOR PUT BULLETS INTO THE BODY OR A 6 MONTH OLD IN A MOVIE THEATER AS WE BLAME THE VICTIMS FOR GETTING KILLED BY A WEAPON OF MASS DESTRUCTION...ONLY IN AMRICA...ONLY IN AMERICA...(N...U...P!!!)
Actually the reason given for the 2nd Amendment relates to the militia. However, the right is granted to the people. Further information about the militia is found in ARTICLE I, SECTION 8 of the Constitution:
To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel invasions;
To provide for organizing, arming, and disciplining, the militia, and for governing such part of them as may be employed in the service of the United States, reserving to the states respectively, the appointment of the officers, and the authority of training the militia according to the discipline prescribed by Congress;
So the question is what is the militia in 2012? Many would say it's the National Guard is the militia, but that is not so, because the 2nd Amendment right is granted to the people, and "National Guard members are a subset of the Militia as defined by 10 U.S.C. § 311".
10 U.S.C. § 311:
(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are—
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.
So logically, category 2 members should be able to own at least a semi-automatic version of the fully automatic assault rifle used by the U.S. military.
Or do we believe that there will never come a time when category 2 members will be called on to defend our nation?
And of course, 10 U.S.C. § 311 could be amended to redefine militia.
An assault rifle ban is at odds with current U.S. law. I don't say illegal, but at odds, because realistically, how do we want the militia to be armed? They would not be much use without this type of weapon. However, magazine capacity could be limited to whatever the U.S. military standard is for the M16A2, which is 30 rounds.

I am not under 45 years of age and am not part of the militia, but I do believe a militia is necessary. And as the Constitution says, "a well regulated militia".
And when was the last time you heard of Congress regulating the militia? LOL.

Here at UPM we are heartbroken by the tragic shootings that took place last week in Connecticut. There are no words to even begin to describe our grief over the young and innocent lives that were taken last Friday. Our love and prayers go out to the community of Newtown, CT which is facing such unspeakable pain.
There are more than 10,000 deaths each year here in the US due to gun violence and homicide. This violence impacts low-income communities of color like many neighborhoods in Oakland at alarming and disproportional rates. But it is far-reaching and moving swiftly across social and economic boundaries. This year alone there have been at least 6 mass shootings nationwide, and just this week Oakland's homicide rate climbed to 123 for 2012.
It is time for us to heed the wake-up call; that our culture of violence is claiming too many precious lives. It is time for decisive change in mental health policy and gun control policy. And most importantly, it is time for us to create a more just and equitable society, one that unites us in shared prosperity.
The culture of violence that plagues our nation is one that stems from an unequal society that fuels division, mistrust, and isolation - a culture that sends subtle and sometimes blatant messages that devalue our humanity and chip away at our sense of self-worth. This is simultaneously a social crisis and a spiritual one.
Everyday at UPM we are inspired by our young leaders who are leading us forward towards peace, with their resolve, their innovation and their commitment - even in a city like Oakland, where these tragedies are not a rare occurrence. In the discussion about mass shootings let us not forget about cities like Chicago, Detroit, and Oakland.
That is why this work is so important - to make a shift towards peace in a young persons life, in a community's reality, in a city's trajectory. Let's build this pathway together, for now and the future. One that leads us toward a peaceful Oakland and a more peaceful nation.
In times of great loss and sorrow we have the choice to let the pain in and let it open us up to new possibilities for living and relating to one another. Or, we can try to block it out and close our hearts. We can choose to acknowledge our own humanity by allowing for a bit of vulnerability. We can learn to breathe into the pain and let it awaken us. Or, we can continue to push each other away, shut down, and succumb to fear.
May we allow our sorrow to open our hearts and may we be reminded of how much we really need each another.
How does it go Irma, can't see the forest for the trees? These are not simple issues and yes, TV programming, video games, media brainwashing, biased education, special interests, corrupt politics, etc. etc.etc. all play a part. Not to mention those ages old concepts covered in the Ten Commandments.
