A civil lawsuit over the 2001 death of 7-month-old Devin Slade, who suffocated in a bed at the home of a foster mother, was thrown out of court for lack of evidence Monday.

In making the ruling, Milwaukee County Circuit Judge Michael Guolee said attorneys for the boy's parents never proved negligence by the foster mother, Anita Lusk, or the state socialworker who put the infant in her home, which lacked a crib for the child.

Lusk lost her foster care license after Devin's June 2001 suffocation. Devin had been sleeping in a bed with Lusk's then-13-year-old daughter and was found dead, his body pinned between the mattress and a wall.

Several state officials at the time decried the "rush" placement of Devin in Lusk's home - the baby's parents had been jailed - without proper checks of whether it was an appropriate place. Guolee said he had seen no proof that Lusk or the socialworker, Amy Hausch, had failed their duties by any specific measure he could ask the jury to punish.
