Hello to all out there, (1114 hits)

This is what I would like to see from you all from time to time since you all do a lot of news postings.

There is a case of this surrogate mother that was carrying or having a baby for another couple. During the regency that doctors discovered that the fetus is abnormal. The DNA parents don’t want the child and requested that the surrogate mother abort the fetus. The surrogate mother says no.

Now, important questions arises that needs to be answered like, who does the baby really belongs to.

These are the things we should be discussing as a way of improving our brains to analytically and rationally thinking. The human brain needs exercising just like the physical body.

So, who would you all say has the last word and why?

King Solomon once had to resolve an issue like this one am I right. How and what did King Solomon use to determine who the rightful mother is?

When we become a sovereign people in a country of our own complex issues are going to pop-up and we need to have keen brain to resolve these issues am I right.

I will bet that some knucklehead will make a comment that has nothing to do with who is the mother of the deform baby.

Hello Steve,

I think the question was who would you say has the last word and why? Please answer the question as it is asked.

You are getting there, but you need to try a little harder.

Give me a break Harry, I did answer the question "who does the baby really belongs to". As far as who has the last word? In the real world Harry, it is probably the court's. Morally however, the mother carrying the baby has more right than the mother that supplied the egg. It is the surrogate mother that gives the baby life. Now if she has agreed to give the baby to the biological mother when she delivers, that's one thing, but that doesn't give the biological mother the right to have her terminate the pregnancy. Clear enough?

the baby belongs to the surrogate whom is actually the mother.
but do we know if she was implanted with dna from both parents or just from the father.
YOU Question as it stands is too vague.

King Solomon said that he would split the baby into ... to determine the rightful mother. Of course the real mother spoke out and told the King to spare the child and let the other woman have the baby. King Solomon then knew the mother whom spoke out was the Actual mother.

Again, you two anologies are not supportive of your stupid statement

Cynthia,

I assumed the egg came from the biological mother. If the egg came from the surrogate mother then she would also be the biological mother. What's the normal case these days, to use just the father's sperm, or in vitro fertilization?

the surrogate who carries the fetus has all rights until the child is born....
invitro is the proceedure that doctors use to implant the egg or sometimes the sperm can't swim up stream, doctors can then just place sperm into the cervix if there are healthy eggs

those are just some of the options a couple can take.

Technically if the eggs/sperm came from the (couple) biological parents (mother/father dna) still the surrogate is the Mother per se until the child is born... The only thing the surrogate is supplying is the house for the baby along with food/illnesses...

However, the fetus will have the dna and characteristics of the donor parents. The laws are crazy from state to state. However, hopefully anyone who gets into this practice has alot to be concerned about.

My cousin and his wife had to use a surrogate to carry their eggs.. she birthed twins...
but once the baby came... They already had all of their legal stuff done before the birth.

Steve,

I am not going to argue with you, but you did not answer my question. The question that is to be answered is this, “so, who would you all say has the last word and why?’ And not, ‘who does the baby really belongs to like you think.

There is a fundamental reason why the question is not the one about who does the baby really belongs to. You are wrong and I am right. Can you analytically figure out why who the baby really belongs to id not the question?

To the second part, you essentially are saying that the surrogate mother has the last word. Well, what then would you do with the contract the both of them signed? Do you disregard the contract? If you do then the laws are meaningless am I right.

Cynthia,

If the surrogate mother has all rights then what do you do with the contract that the both of them signed and the money paid to the surrogate mother?

Is the contract the deciding factor or us some else the deciding factor? I would broadly say that the contract is the deciding factor. Am I wrong?

If in fact there is a Non-Waiver Contract then that is correct Harry. You are correct.

You're the one studying law Harry. In your nation, if you are Chief justice, what would you say?

Maybe a new TV series? Judge Harry? Gots a ring to it.

Cynthia,

Yes, there is a contract in place. Even so I don’t know if I am really correct and that is why I asked you opinion. Analytically thinking I would suppose strongly that the contract would govern.

Anyway the biological parents abandon the child to adoption like they said they would do and the surrogate mother will allow the child to be adopted.

Did you hear about it through CNN news? It was on the news last week for a couple days.
